We, MB Baltijos menai, a small partnership registered at Šatrijos Raganos 58, Vilnius, e-mail: galerija@baltijosmenas.lt, telephone: +370 611 11888 (hereinafter referred to as the “Data Controller” or “Baltijos Menas”) respect persons right to privacy and shall make all reasonable efforts to ensure the security and confidentiality of personal data and other information that is processed on this website in accordance with the relevant legislation of the Republic of Lithuania and the General Data Protection Regulation (hereinafter referred to as the “GDPR”).

 

By accessing our website and/or using the information contained therein and/or using our services, you acknowledge and affirm that you have read and understood this Privacy Policy. This Privacy Policy does not apply to our other online or non-online stores, products, or services. We reserve the right to change this Privacy Policy at our own discretion, so make sure you are familiar with the latest version of the Privacy Policy that will be applied every time you visit our website.

 

  1. The scope of this Privacy Policy

This Privacy Policy applies to the personal data we collect on our website www.baltijosmenas.lt (hereinafter referred to as the “Website”). The Privacy Policy describes how we use your personal data and specifies your rights related to data protection, including the right to a certain portion of data processed by us.   • Why we process your personal data
  • We process personal data for the following purposes:

 

  • Creating and administering customer’s account on the Website. Processed personal data: e-mail address, password generated by the customer, other personal data related to the purchase of the artwork and provided by the customer (e.g., information about the delivery address, door locks, etc.). These personal data are stored for 5 years after the Customer’s last login to the Website or last order.
  • Online sale of artworks and subsequent customer service. Processed personal data: name, surname, address, e-mail address, telephone number, and other contact details. These personal data are stored for 5 years after the Customer’s last login to the Website or last order.
  • Ensuring online payment for online services. Processed personal data: name, surname, IP address, payment URL link, encrypted payment content received in order to determine the authenticity of an electronic document, payment type, payment amount, telephone number, e-mail address. These personal data are stored for 5 years after the Customer’s last login to the Website or last order.
  • Direct marketing, i.e., providing you with information about Baltijos Menas activities, products, or services. Processed personal data: e-mail address. Consent for the use of personal data for marketing purposes is expressed by ticking the “Subscribe to newsletter” box. Without ticking the box, personal data is not processed for marketing purposes. The customer has the right to withdraw his/her consent at any time by responding the e-mail or calling to our telephone. These personal data are stored for 5 years after the Customer’s last login to the Website or last order.
  • Communication. We process your personal data in order to be able to respond to your requests or other questions submitted through the Website.

 

If you order and do not pay for the artwork, Baltijos Menas shall store your personal data for 3 (three) years from the moment the order was placed.

If the customer fails to provide all or part of the data specified in the Privacy Policy, Baltijos Menas will not be able to fulfil the above-mentioned purpose (s), i.e., customer’s account will not be created and/or the customer will not be able to purchase the artwork (s) and/or will not be able to pay for them online.

 

 

  1. Sharing your personal data

 

Baltijos Menas undertakes not to transfer or otherwise disclose to third parties the personal data that were submitted to it, except in the following cases:

 

  • The person gave his/her consent.
  • For law enforcement authorities in accordance with the procedures specified in the legal acts of the Republic of Lithuania.
  • If necessary to prevent or investigate criminal offenses.
  • In other cases specified in the legal acts of the Republic of Lithuania and international agreements concluded by the Republic of Lithuania.

Baltijos Menas may disclose your personal data to the following categories of recipients (in all cases only when necessary for the performance of their functions):

 

  • To our employees (including employees and independent consultants), professional advisors, and representatives.

 

  • To third parties that are our service providers, process your personal data on behalf of Baltijos Menas, and are bound by contractual obligations to maintain the confidentiality of your personal data and protect them accordingly, i.e.:

 

  • Personal data collected for online payment purposes may be disclosed to UAB Paysera LT, PayPal Holdings, Inc, or other payment service providers.
  • Personal data collected for the purpose of framing the artwork are disclosed to the framing service providers indicated on the Website. You will see this information after choosing a framing service.
  • Personal data collected for the purpose of artwork delivery may be disclosed to Lietuvos Paštas, UAB DPD Lietuva, Venipak, TNT, UPS, and other delivery companies. Personal data can be disclosed only for the purpose of artwork delivery.
  • Personal data can be disclosed to other subjects only with the prior consent of the person.
  • To government institutions, regulatory institutions, and law enforcement officers if necessary for the above-mentioned purposes or in order to protect our legitimate interests in accordance with applicable laws or this is specified in legal acts.
  1. Direct marketing

Sometimes you may receive our e-mails with information about new artworks, replenishment of the gallery’s stock, and additional services. In your account, you can specify that you do not want to receive such e-mails.

Also, each time you receive a newsletter from Baltijos Menas, you will have the opportunity to indicate that you no longer want to receive such newsletters.

Your information is stored for 5 (five) years for the purpose specified in section III (Why we collect your personal data) of this Privacy Policy or, in accordance with applicable law, for a period necessary to fulfil the purposes specified above.

 

In accordance with applicable legal acts, you may have the right to request Baltijos Menas to provide a copy of your information, correct or delete the information, restrict its processing, or transfer some of that information to other subjects. You may also object to a specific personal data processing. In some cases, these rights may be limited, for example, when we can prove that there is a legal requirement to process your personal data.

 

When you consent to the processing of your personal data, you may withdraw that consent at any time.

  1. The right of access, right to rectification, and right to object

The data subject has the right to request access to his/her personal data collected by us and be informed on how his/her personal data are being processed.

 

The data subject has the right to request rectification of inaccurate personal data concerning him/her free of charge. Also the data subject has the right to object to the processing of his/her personal data and object to the disclosure of these data to third parties, except in such cases where this is necessary for the provision of services specified on the Website.

 

You can send the subject access request or rectification request to galerija@baltijosmenas.lt. Please indicate your name, surname, username, and other registration details (if any) in your request.

  1. Third party websites

We are not responsible for securing your privacy on third party websites even in such a case where you access third party websites through the links on our Website. We recommend that you read privacy policies of each website that is not ours.

 

  1. Ensuring information security

Our goal is to maximize the security of all information that we receive from you and from public data files. We implemented various administrative, technical, and physical security measures to protect this information from unauthorized access, use, copying, or disclosure.

  • International data transfer

Baltijos Menas operates in Lithuania, and therefor your information will not be transferred outside the country and European Economic Area.

 

In the event that in the future this information will be transferred outside the designated area, we will make an effort to keep your personal data protected. For example, Baltijos Menas would transfer the information to the United States of America in accordance with the provisions set out in the Privacy Shield and to other countries in accordance with the standard contractual clauses approved by the EU Commission.
