RULES FOR USE OF BALTIJOS MENAS ONLINE STORE

 

 

Every visitor ordering and buying products on the Baltijos Menas online store undertakes to comply with the specified rules (hereinafter referred to as the “Rules”) and relevant legal acts of the Republic of Lithuania.

 

  1. General provisions

 

  1. These Rules are established in order to ensure your (hereinafter referred to as the “Customer” or the “Buyer”) rights and the rights of Baltijos Menas online store and to establish the obligations and responsibilities of both parties.

 

  1. The purchase contract between the Buyer and the Seller is considered to be concluded from the moment the Buyer in the Baltijos Menas online store chooses the desired artwork (s), puts it/them to the shopping chart, indicates the delivery address and the method of payment, and, after reading these terms and condition, clicks the “Buy” button and shall remain in force until the obligations of both parties are properly fulfilled.

 

  1. Each contract concluded between the Buyer and the Seller is stored by the small partnership MB Baltijos menai in accordance with the Privacy Policy which can be found at baltijosmenas.lt.

 

  1. The author or seller of the artwork that was provided to the Baltijos Menas online store takes the responsibility for the copyright and property right. If the Buyer has any suspicions about any artwork, Baltijos Menas shall make an effort and help the Buyer to resolve any potential disputes.

 

  1. Baltijos menas has the right to change the Rules at any time. The Customer shall be subject to the Rules that are in force at the moment of purchase.

 

  1. Purchase and delivery of the artwork

 

  1. The order is deemed to be submitted when the Customer clicks on the “Pay” button to confirm that he/she purchases the item (s) that is/are in the shopping cart.

 

  1. The order is deemed to be accepted when the payment is received to the relevant settlement account of Baltijos Menas. The Buyer receives the order confirmation to his/her e-mail.

 

  1. If the Customer does not pay for his/her order within 2 (two) business days, the order is cancelled, unless the Customer has separately in writing agreed on a different payment term.

 

  1. The goods are delivered in the manner chosen by the Customer. If you wish to receive the order using courier services, the courier in advance will arrange the delivery time by calling to your phone.

 

  1. Buyer’s obligation to inspect the parcel. The parcel is considered to be delivered when the Buyer or his/her representative accepts the parcel and confirms this with his/her signature. The Buyer must check the packages of the parcel at the time of the delivery and in the presence of the courier. After noticing that the package is damaged, the Buyer must indicate this in the delivery confirmation document and, together with the courier, must fill in the packaging damage (inspection) report provided by the courier. If the Buyer fails to fulfil this obligation, the Buyer loses his/her right to demand from the Seller to take the responsibility for the quality of the artwork.

 

  • Return of the artwork

 

  1. The artwork must be returned in accordance with the provisions set out in the 29 June 2001 Order No. 217 of the Minister of Economy of the Republic of Lithuania on Approval of Rules for Return and Exchange of Goods.

 

  1. According to the 17 August 2001 Order No. 258 of the Minister of Economy of the Republic of Lithuania on Approval of Rules for Selling Goods and Providing Services by Concluding Contracts Using Means of Communication, in order to return the artwork, the Buyer must complete the application form and send it to the seller (by e-mail: galerija@baltijosmenas.lt or by a registered mail) within 7 business days from the day of delivery of the artwork.

 

  1. In order for the artwork to be exchanged or returned, it must meet the following requirements:

 

  • The artwork must not be damaged or otherwise harmed.

 

  • The seller shall not be liable if the size, shape, and colour of the goods (artworks) on the Baltijos Menas online store differs from the actual size, shape and colour of the goods due to the features of the display used by the Buyer.

 

  • If the Buyer withdraws from the artwork (goods) purchase contract, the artwork must be returned to the seller at its expense within 15 (fifteen) days from the day the Buyer submits a written notice of termination of the purchase contract. The Goods that the Buyer does not like because of their form, size, colour, model, or assortment (except for the exceptions specified in legal acts of the Republic of Lithuania) may be returned or exchanged within 15 (fifteen) days from the day the goods were delivered to the Buyer. The goods are returned at the Buyer’s expense.

 

  • The artwork (goods) must be returned in its original package (package of the artwork and the package of the parcel), fully assorted and properly packed, i.e., as the Buyer has received it.

 

  • The artwork (goods) will not be accepted if it has been used and/or damaged and/or lost its commercial appearance (changes in the appearance of the artwork or its packaging that were made in order to inspect the product are not considered to be essential changes in the artwork’s appearance).

 

  1. If the order indicates that the parcel will be insured, the Buyer must also comply with such insurance rules. If the Buyer fails to comply with such rules, the insurance shall not be valid.

 

  1. Limitation of seller’s liability

 

  1. Baltijos Menas is exempt from any liability if the losses occur:

 

  1. Due to the fact that the Customer did not take into account the recommendations he/she was given, did not fulfil his/her obligations, or did not read these Rules, even though such a possibility was given to him/her.

 

  1. Due to the actions of other people, who are not controlled by Baltijos Menas.

 

  1. If the author of the artwork delivers the artwork purchased through the website baltijosmenas.lt himself/herself, Baltijos Menas and the author will be jointly responsible in accordance with the provisions of the cooperation agreement.

 

  1. Seller’s and Buyer’s rights

 

  1. Seller’s rights:

 

  • restrict or prohibit the use of the online storebaltijosmenas.lt without prior notice if the Buyer deliberately attempts to harm the operation of the online store;

 

  • temporarily or indefinitely stop the operation of the online store without prior notice;

 

  • unilaterally amend and supplement these Rules without prior notice. The updated version of the Rules is publicly available on baltijosmenas.lt. The changes of the Rules do not affect the order that has been already made;

 

  • other rights specified in these Rules and legal acts of the Republic of Lithuania.

 

  1. Buyer’s rights:

 

  • demand the Seller to exchange the artwork if it is fundamentally different from the one that has been ordered and the Buyer has not been notified about this;

 

  • return the artwork in accordance with the provisions set out in the 29 June 2001 Order No. 217 of the Minister of Economy of the Republic of Lithuania on Approval of Rules for Return and Exchange of Goods.

 

  1. Seller’s and Buyer’s obligations

 

  1. The Seller undertakes to:

 

  • Enable the Buyer to properly use the services provided on the online store baltijosmenas.lt.

 

  • Arrange the delivery of goods ordered by the Buyer and send it to the address specified by the Buyer. The goods are being sent directly from Baltijos Menas or by the author of the artwork.

 

  • Safely pack artworks so that they would not be damaged during the transportation to the Buyer.

 

  • In the event of unforeseen circumstances or if the Seller is unable to deliver to the Buyer the artwork he/she has ordered, immediately offer the Buyer an analogous or similar artwork or extend the delivery term, and, if the Buyer refuses this offer or term extension, to return the money paid by the Buyer within 5 business days. In such a case, the Buyer’s purchase is deemed to be cancelled.

 

  1. The Buyer undertakes to:

 

  • Pay for the order within 2 business days.

 

  • Immediately inform the seller about the change of personal data provided by the Buyer (especially if the delivery address changes).

 

  • Check the received parcel in front of the courier and, after identifying defects or any discrepancies of the order, document and inform the Seller about this.

 

  • Comply with other requirements set out in these Rules and legal acts of the Republic of Lithuania.

 

 

  • Electronic gift card

 

  1. The electronic gift card of Baltijos Menas (hereinafter referred to as the “Gift Card”) is valid for 6 (six) months from the purchase date and this term cannot be extended.

 

  1. The gift card cannot be returned and cannot be exchanged for money.

 

  1. The money for the unused Gift Card shall not be refunded.

 

  1. If the price of the artwork that the Buyer wants to purchase from Baltijos Menas is higher than the value of the Gift Card, the price difference can be paid by transferring it to the bank account of Baltijos Menas. The Buyer must inform the seller about this indicating the unique Gift Card number, the chosen artwork, and the price difference.

 

  1. Please note that if the price of the artwork is lower than the amount indicated on the Gift Card, the unused amount of the Gift Card will not be returned to the Buyer.

 

  1. After making the payment and indicating the e-mail address, the Gift Card will be immediately sent to the specified address.
